SchwammADR offers Settlement Strategy Consultation to help counsel and clients evaluate litigation risk, refine settlement posture, and prepare complex cases for productive negotiation. Drawing on more than three decades of experience litigating medical malpractice and catastrophic injury cases on both sides, Richard provides balanced insight into liability, damages exposure, and trial dynamics.
In certain matters, Richard will prepare a confidential “MyNeutralView” analysis worksheet for the retaining party, offering a clear assessment of the case at one of the key stages of litigation:
Early Presuit: An independent evaluation conducted before a lawsuit is filed to help a party determine whether and how a case should be pursued or defended. This review focuses on the strengths and weaknesses of the claims or defenses, potential liability exposure, and whether early resolution should be considered.
Pre-Mediation: A strategic case assessment and review of presentation materials conducted before mediation to help counsel and clients evaluate litigation risk, refine settlement positions, and approach mediation with a clearer understanding of the legal, factual, and damages issues likely to shape negotiation.
Pre-Trial: A detailed case evaluation conducted as trial approaches, providing a neutral assessment of the evidence, potential jury dynamics, and litigation risk to help parties realistically consider settlement before presenting the case to a jury.
The goal of these conferences and evaluations is to provide a practical, balanced perspective that helps parties make informed decisions and approach negotiation with greater confidence.
All services are performed in a neutral capacity and in accordance with applicable professional and ethical standards.
Richard offers either a half-day (up to four (4) hours) or full-day (up to eight hours (8) hours) session. The retaining party is encouraged to provide Richard Schwamm with case materials like excerpts of medical records, timelines, depo summaries, key pleadings, PowerPoint presentations and other relevant materials. Sixty (60) minutes of Richard’s preparation time is included within the FEE SCHEDULE OVERVIEW (extra time needed may be billed separately on an hourly basis).
